David Fortney is a commercial litigator with a practice focusing on business disputes, securities litigation and fraud, corporate control / governance disputes, and fiduciary litigation. He also has substantial experience in class actions, employment litigation, insurance coverage, and real estate disputes. He handles matters for a wide range of clients, from small startup companies to Fortune 50 corporations, and individual investors to professional athletes. Moreover, David litigates cases on both the defense and plaintiffs’ side, has tried numerous matters to verdict, and has handled a wide variety of appellate matters in the California appellate courts and the Ninth Circuit Court of Appeal.
With over 20 years of experience across nearly every substantive practice area relevant to business, David is also sought out by clients to serve as “outside general counsel” to advise on everyday business issues, employment practices, company formation, equity issuances, business combinations or partnerships, and prelitigation negotiations.
David began his career at Latham & Watkins LLP in San Francisco, handling mergers and acquisitions and securities issuances before transitioning to commercial and securities litigation. After Latham, David co-founded Ogloza Fortney LLP, a litigation boutique in San Francisco, and served as its managing partner for many years. He is licensed and actively practices in both California and Texas.
David earned his law degree from the University of Texas School of Law in 2003, where he served as an Articles Editor of the Texas Law Review. Prior to law school, he graduated from the University of Virginia in 1999, where he majored in political and social thought. Between undergrad and law school, David enjoyed a brief but exciting stint as an editor at HarperCollins Publishers.
